1. Introduction and Acceptance
These Terms of Service ("Terms") form a legal agreement between you and AIA Innovation (Shenzhen) Technology Co., Ltd ("AIAFUNS", "we", "us", or "our") and govern your access to and use of our website, mobile applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
2. Eligibility (18+)
The Services are intended exclusively for adult users who are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater). By accessing or using the Services, you affirmatively represent and warrant that you meet this age requirement. The Services are not designed for, marketed to, or directed at minors.
AIAFUNS may, at its discretion, require additional age verification, and may suspend or terminate any account that we reasonably believe belongs to an underage user.
3. Account Registration and Security
You must provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify AIAFUNS promptly of any unauthorized access. AIAFUNS is not liable for losses arising from your failure to maintain account security.
4. License to Use the Services
Subject to your compliance with these Terms, AIAFUNS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.
5. Acceptable Use
You agree not to use the Services to generate, distribute, or solicit content that:
- Infringes intellectual property, privacy, publicity, or other rights of any third party;
- Is unlawful, fraudulent, deceptive, threatening, harassing, defamatory, or hateful;
- Sexually exploits, abuses, endangers, or grooms a minor, or otherwise involves minors in sexual or harmful contexts;
- Glorifies or instructs self-harm, suicide, or eating disorders;
- Promotes terrorism, violent extremism, or organized criminal activity;
- Contains malicious code, malware, or content designed to disrupt systems;
- Impersonates a real person, including via deepfakes, without that person's consent;
- Attempts to extract personal information from other users, especially anyone under 18;
- Constitutes unsolicited advertising, spam, or commercial solicitation;
- Provides medical, legal, financial, tax, or other professional advice as if from a licensed professional.
You also agree not to:
- Violate any applicable law or regulation;
- Attempt to access, probe, or compromise the security of the Services or other users' accounts;
- Reverse engineer, decompile, or attempt to extract the underlying source code of the Services, except where permitted by law;
- Lease, lend, sell, or sublicense the Services;
- Use automated means (bots, scrapers, crawlers) to access or harvest data from the Services without our written permission;
- Evade any technological access control or content moderation measure.
6. User Content
"User Content" means any content you submit, upload, or generate through the Services, including messages, characters, prompts, and configuration data. You retain ownership of your User Content. By submitting User Content, you grant AIAFUNS a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, and use the User Content as strictly necessary to operate, secure, maintain, and improve the Services for you.
You are solely responsible for your User Content and represent that you have all rights necessary to submit it. AIAFUNS may, but is not obligated to, review, remove, or refuse User Content that violates these Terms or applicable law.
7. Intellectual Property
The Services, including all software, designs, text, graphics, models, and other materials (excluding User Content), are owned by AIAFUNS or its licensors and are protected by copyright, trademark, and other intellectual property laws. AIAFUNS reserves all rights not expressly granted to you in these Terms.
AIAFUNS respects the intellectual property of others. If you believe that material on the Services infringes your copyright, please contact contact@aiafuns.com with sufficient information to identify the work and the alleged infringement. AIAFUNS will respond consistent with applicable law.
8. Third-Party Services
The Services may interoperate with, or contain links to, third-party services, including large language model providers, cloud infrastructure, payment processors, and app store platforms. AIAFUNS is not responsible for the content, policies, or practices of such third parties, and your dealings with them are governed by their own terms.
9. Paid Services
Certain features of the Services may require payment. If you purchase a subscription or paid feature, you authorize AIAFUNS or the relevant app store to charge the applicable fees. Subscriptions auto-renew at the agreed interval until cancelled. You may cancel at any time through your account settings or via the app store from which you purchased the subscription. Except as required by mandatory law, payments are non-refundable.
10. Disclaimers
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. AIAFUNS does not warrant that the Services will be uninterrupted, error-free, accurate, or fit for any particular purpose. AI-generated responses are produced by probabilistic models and may be inaccurate, inappropriate, or offensive. You should not rely on AI-generated content for medical, legal, financial, or other professional decisions.
11. Limitation of Liability
To the maximum extent permitted by applicable law, AIAFUNS and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of the Services. AIAFUNS' aggregate liability for all claims arising from or related to the Services shall not exceed the greater of (a) the amount you paid AIAFUNS in the twelve months preceding the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, in which case those limitations apply only to the extent permitted by law.
12. Indemnity
You agree to defend, indemnify, and hold harmless AIAFUNS and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use or misuse of the Services, (b) your User Content, or (c) your violation of these Terms or any applicable law.
13. Termination
AIAFUNS may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time and may delete your account through the in-app settings. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China, including the Personal Information Protection Law, the Cybersecurity Law, the Data Security Law, and the Law on the Protection of Minors, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the competent People's Court located in Shenzhen, China, except where mandatory consumer protection law in your jurisdiction provides otherwise.
15. Changes
AIAFUNS may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date and, where required, communicated to you directly. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
